Administrative Law Judge Barbara Case will hold a probable cause hearing Monday, Nov. 4 at 10 a.m. regarding David Johnson’s complaint against Citizens Against Racism IN Government (CARING). The hearing will take place via telephone. The judge found the organization in violation of Minnesota Statute §211A.02, which requires candidates or committees who make disbursements of over $750 to file an initial campaign report within 14 days of making the payment. If the judge finds the law has been violated, it will trigger an evidentiary hearing.
Judge Case dismissed Johnson’s second complaint that the letter violated campaign law by distributing false information about candidates, saying the statute is unconstitutional and unenforceable.
